What is Workplace Discrimination?

Workplace Discrimination is covered by the Equality Act 2010, which states it is unlawful to treat someone unfairly because of the listed protected characteristics. There are a range of these, including:

  • Age
  • Disability
  • Gender reassignment
  • Marriage and civil partnership
  • Pregnancy and maternity
  • Religion or belief
  • Race
  • Sex or sexual orientation

Types of Discrimination

The Equality Act states that there are a range of forms that workplace discrimination can take, including:

  • Direct Discrimination- being treated less favourably because of a protected characteristic.
  • Indirect Discrimination- where a workplace policy or practice disadvantages a group that share a protected characteristic.
  • Harassment- unwanted conduct related to a protected characteristic that violates dignity or creates an intimidating or hostile work environment for yourself.
  • Victimisation- being treated unfavourably because you raised or supported a complain of discrimination.

Time Limits

As with most employment claims....

  • Discrimination claims must usually be brought within three months less one day of the act complained of.
  • ACAS Early Conciliation is normally required before issuing proceedings.
